BCCI and the RTI Act: A Contested Exemption

This ruling is expected to face considerable challenge, primarily because the BCCI, despite its private operational structure, essentially holds a monopoly over a national sport, wielding immense power and influence.Proponents for the BCCI’s exclusion often point out its commercial nature, asserting that it lacks direct public financing. They argue that RTI disclosures could potentially expose sensitive competitive information, thereby undermining the flexibility essential for managing a dynamic sport. Furthermore, they highlight existing anti-corruption mechanisms and the availability of judicial review, suggesting these are sufficient safeguards . A concern is also raised about the potential for political entities to take advantage of transparency demands, possibly leading to undue interference in cricket administration.However, a compelling counter-narrative emphasizes the BCCI's deep integration with public life. The organization demonstrably benefits from national prestige, state hospitality, and the deployment of police services during matches. It frequently utilizes public stadium infrastructure and receives concessional land allotments. Its regulatory dominance, stemming from its monopoly, grants it substantial privileges , and its interactions with foreign sporting bodies often venture into quasi-diplomatic territory. These pervasive public engagements have consistently fueled civil society's apprehension regarding the BCCI's lack of scrutiny over its potential conflicts of interest and governance frameworks.Legally, the debate hinges on Section 2(h) of the RTI Act, which determines if an entity is under state control or financing. The Supreme Court, in previous rulings (2015-16), affirmed the BCCI's role in performing public duties. The Law Commission further echoed this in 2018, noting its undeclared status as a National Sports Federation and substantial historical tax exemptions, which it characterized as foregone state revenue. The current CIC reversal, despite acknowledging BCCI's public influence, is based solely on Section 2(h), creating a clear dichotomy . There's an inherent contradiction : while courts can exercise writ jurisdiction over the BCCI due to its public functions, it remains shielded as a private body from accountability. This situation underscores the urgent need for amendments to Section 2(h) to explicitly include bodies performing public duties, especially those with monopoly power, perhaps even while carefully safeguarding their legitimate commercial interests.
