Judicial Scrutiny on Electoral Roll Exclusions and Welfare Access

The Supreme Court has once again affirmed its consistent stance: exclusion from electoral rolls cannot bear upon consequences unrelated to the act of voting. This reassertion came in response to orders issued by the West Bengal government in May-June, which controversially tied in welfare benefits and official caste certifications to the outcomes of the Special Intensive Revision (SIR) of electoral rolls. Under these directives, individuals whose names were removed would lose eligibility for specific welfare schemes and caste certificates. A May 19 notification, for instance, mandated that those deleted from the electoral roll could not remain beneficiaries of the Annapurna Yojana, a cash transfer program for women, unless they had lodged appeals with the SIR tribunal. Furthermore, a June 4 order directed the deletion of beneficiaries from the Public Distribution System, while a May 14 decision initiated a re-verification process to cancel caste certificates of individuals whose names were no longer on the rolls. Such actions directly contravene the clear instructions previously issued by the Supreme Court in the Bihar SIR case, which explicitly prohibited authorities from utilizing SIR outcomes for any purpose other than determining eligibility to vote. The Court has now issued formal notices to the Election Commission of India, the West Bengal government, and the State’s Chief Electoral Officer, highlighting the gravity of the situation. With approximately 34 lakh appeals filed against SIR outcomes in West Bengal, and only a tiny fraction processed, millions remain in a precarious state of uncertainty . Their potential disqualification from essential welfare provisions, including vital food support, is deemed unconscionable . There exists a perplexing legal paradox concerning citizenship and the electoral roll. While the roll is intended exclusively for citizens, enrollment itself does not constitute definitive proof of citizenship. Irrespective of this complexity, it is a logical and widely accepted premise that many citizens are not registered as voters. Thus, all registered voters must undeniably be citizens, but it does not follow that all citizens are necessarily registered voters. While this might seem a straightforward proposition, the State’s decision to connect up a person’s absence from the electoral roll with other critical aspects of civic life—especially basic subsistence benefits—is both irrational and ethically reprehensible . In its Bihar SIR judgment, the Court unequivocally stated that exclusion from an electoral roll cannot singularly determine citizenship status and that SIR outcomes are strictly confined to electoral functions. Beyond the specific facts and legal principles of the SIR, broader implications are at play. These encompass universal human rights that should apply to all individuals, regardless of their citizenship status. While maintaining clean electoral rolls and ensuring targeted welfare delivery are important for good governance, the state must not depart from fundamental logic and common sense, thereby compromising basic human dignity and rights.
