A threat to tribal autonomy

The foundational rights of India's tribal communities face an imminent peril as the state appears poised to undermine key protections embedded within the Forest Rights Act (FRA). Recent recommendations, particularly from the Committee on Public Undertakings, call for a dangerous shift: instead of requiring unanimous consent from all affected Gram Sabhas for development projects, a mere majority (70-75%) could suffice . This proposed alteration fundamentally transforms these democratic village councils, designed to safeguard constitutional entitlements , into mere corporate entities whose dissenting voices can be easily overridden . Such a move would allow project developers to circumvent critical opposition from directly impacted villages, such as those situated within a proposed reservoir, by doing away with the necessity for universal agreement and instead securing approvals from less affected areas.

This erosion of tribal autonomy is further complicated by ongoing political maneuverings to redefine tribal community membership, a strategy that could facilitate the manipulation of village assembly decisions and engineer consent. The disconcerting refusal of the Tribal Affairs Ministry to assert jurisdiction over these critical policy changes exacerbates the situation, creating a perilous regulatory void . This vacuum permits central and state governments to arbitrarily revise regulations governing the diversion of forested lands for non-forest purposes, effectively stripping of tribal populations their most potent legal tool against displacement .

Historically, the FRA came down to an effort to rectify the egregious injustices endured by forest-dwelling communities. Yet, the current governmental stance, which dismisses the comprehensive consent requirement as non-existent within the FRA's original framework, is demonstrably disingenuous . Any such significant legal modification , if brought about by the Environment Ministry, must be enacted explicitly and transparently through legislative changes. Land forms the very bedrock of tribal identity, culture, subsistence , and self-governance . Invaluable are their contributions to both national development and climate commitments; it is therefore imperative that the Centre and States bolster the authority of Gram Sabhas, particularly through existing legislation like the Land Acquisition and PESA Acts, rather than weaken them. This proactive approach is vital to preserve the inherent rights and ecological stewardship of indigenous populations.
